From H-2 to a Green Card: Realistic Routes and Timelines (2026)

Many seasonal workers quietly hope that years of H-2 seasons will one day turn into a green card. It is an understandable hope, and it deserves an honest answer: there is no automatic path, no points system and no reward for seniority, but there are real routes that some H-2 workers do successfully take. Here is what they look like, stripped of wishful thinking.

First, the hard truth about H-2 status itself

H-2A and H-2B are strictly temporary, nonimmigrant categories. Years of seasons do not accumulate toward residence, and the visa requires you to intend to return home. That said, US law does allow an employer to sponsor an H-2 worker for permanent residence, and pursuing it does not by itself violate your status, though it can complicate future consular interviews because officers weigh your intent to return. This tension is real and worth understanding before you start.

Route 1: employer sponsorship through EB-3 "other workers"

The main employment route for people doing seasonal-type work is the EB-3 category for unskilled or "other" workers. The employer must:

  • Prove a permanent, year-round need, not a seasonal one, which is why a farm that only harvests three months a year usually cannot sponsor a picker, but a dairy, nursery, mushroom farm, year-round packing house or landscaping firm with winter operations sometimes can
  • Complete PERM labour certification, testing the US labour market
  • File the immigrant petition and wait out the visa queue

Timelines are long. The EB-3 other-workers category has a small annual quota and significant backlogs, which vary sharply by country of birth. Realistically, plan in terms of several years from PERM to green card, and often much longer for heavily backlogged countries. Some workers spend the wait continuing normal H-2 seasons; others complete the final step through consular processing from home.

Route 2: family-based immigration

Marriage to a US citizen or sponsorship by a citizen or resident family member remains the most common way seasonal workers actually become residents. Family petitions follow their own queues, from immediate (spouses of citizens) to many years (siblings). Nothing about H-2 status blocks these routes, but misrepresenting a relationship is fraud with permanent consequences.

Routes that come and go: legislative proposals

Congress has repeatedly debated bills that would create earned-residence paths for long-term farmworkers. None had become law as of early 2026. Never make life decisions based on a bill that might pass; act on the law as it stands and check uscis.gov for changes.

Questions to ask a potential sponsor

If an employer raises sponsorship, treat it seriously but verify substance. Ask: is the sponsored position genuinely year-round, and what is the job title being filed? Has the company sponsored workers through PERM before, and did those cases complete? Who pays the legal and filing costs? By law the employer must pay PERM-related costs, and an employer asking you to fund the labour certification is already breaking the rules. Ask for a realistic timeline in writing from their attorney, and be wary of any employer who uses a vague green card promise mainly to extract extra unpaid loyalty season after season without ever filing anything.

Myths to discard

  • "After X years you qualify automatically." False. There is no time-based conversion.
  • "A lawyer can buy you a place in line." Queues are set by law. Anyone selling guaranteed green cards is a fraudster, and workers should never pay recruiters for jobs or status.
  • "Overstaying and waiting works." Overstays trigger re-entry bars and can permanently close the legal doors described here.

A realistic strategy

Build seasons with year-round employers where possible, keep a spotless immigration record, and raise sponsorship only with an employer who genuinely values you; the ones who sponsor are usually those trying to keep a proven worker permanently. Meanwhile, understand the broader system through our guides to US work visas and how sponsorship works.

This article is general information, not legal advice. Green card processes are complex and country-specific; consult uscis.gov and, for an individual case, a licensed immigration attorney.
