RFEs: What Happens When USCIS Asks for More Evidence

Few envelopes cause more panic than the one containing a Request for Evidence. Take a breath: an RFE is not a denial. It is USCIS saying "we might approve this, but we need more." Handled well, most RFE cases are approved. Here is what actually happens and how you can help.

What an RFE is

When a USCIS officer reviews a petition - most relevantly your employer's I-140, or later your I-485 - and finds the evidence incomplete or unconvincing on some point, they can issue a Request for Evidence instead of deciding. The notice lists exactly what is missing and sets a deadline, commonly around 87 days for an I-140. The case freezes until the response arrives; one response is allowed, so it must be complete.

Common RFE triggers in EB-3 cases

  • Ability to pay. The most frequent I-140 issue: the employer's tax returns or financials do not clearly show they can pay the offered wage from the priority date onward. The fix is usually more financial documentation - entirely the employer's job.
  • Experience evidence. Your experience letters are vague, undated, unsigned, or do not match the PERM requirements. This is the RFE where the worker matters most.
  • Education equivalence. A foreign diploma needs a credible credential evaluation showing it matches what the job requires.
  • Successor or job questions. The company changed name, merged or moved, and USCIS wants proof the job offer survives.
  • On the I-485: missing medical forms, incomplete vaccination records, or gaps in status history.

What you should do

  • Move fast on documents only you can get. If the RFE concerns your work history, contact former employers immediately. A proper experience letter is on company letterhead, signed by a supervisor or HR, and states your dates, hours per week and specific duties - not just a job title.
  • When a company no longer exists, alternatives such as affidavits from former supervisors or colleagues, old contracts, payslips and tax records can help. Gather everything; let the attorney choose.
  • Tell the truth. Never backdate, inflate a title or "fix" dates. Misrepresentation discovered later can end not just this case but any future US immigration - permanently.
  • Stay reachable. The employer's attorney may need scans from you within days, possibly with certified translations. Slow worker responses are a common reason RFE answers go out weak.

What happens after the response

USCIS resumes processing - if premium processing applies, a fresh short clock starts. Outcomes are approval, denial, or occasionally a further notice. If the response deadline is missed entirely, the case is decided on the existing record, which usually means denial - so calendars matter more than eloquence.

Keeping perspective

RFE rates rise and fall with policy climates, and receiving one says nothing about your worth as a worker. Well-documented cases with responsive workers overwhelmingly survive them. What an RFE cannot be fixed with is money to a middleman - no one can "settle" an RFE for a fee, just as nobody legitimate charges workers for a job offer in the first place.

A strong file from day one is the best RFE insurance, which is why we bang on about experience letters in our I-140 guide.

NOIDs and denials: the steps beyond an RFE

Two related notices are worth knowing. A Notice of Intent to Deny (NOID) is sterner than an RFE - the officer leans toward refusal and gives a shorter window to change their mind with evidence. A denial ends the petition, but rarely the story: depending on the reason, the employer can file a motion to reopen or reconsider, appeal, or simply refile a corrected petition. A denied I-140 does not blacklist you as a worker, and an honestly failed case does not damage future applications. What does damage them is panic-driven shortcuts - fabricated documents produced under deadline pressure. If a case wobbles, slow, honest fixes with a licensed attorney beat fast fictions every single time.

This is general information, not legal advice. RFE procedures and response deadlines are set by USCIS - see uscis.gov, and let a licensed attorney draft any actual response.
