Bringing Your Family: Spouse and Children Visas for U.S. Workers (H-4 and Others)

For many workers, the real question behind a U.S. job is not the salary, it is "can my family come with me?" The answer depends entirely on your visa category. Some work visas have dependent visas for spouses and children; others, including the common seasonal programs, do not offer a practical family path. Here is how it works, category by category.

The general rule: dependent visas mirror the worker's visa

Most longer-term U.S. work visas have a companion category for the worker's spouse and unmarried children under 21. The dependents' status is tied to yours: they can stay as long as your visa is valid, and if your status ends, theirs generally ends too. Children age out of dependent status at 21.

Worker visaDependent visaCan the spouse work?
H-1B (specialty occupations)H-4Only in limited cases, mainly when the H-1B holder is far along in the green card process; H-4 spouses in that situation can apply for work authorization. Check current rules at uscis.gov.
L-1 (intracompany transfer)L-2Yes, L-2 spouses are considered work-authorized under current policy.
E-1/E-2 (treaty trader/investor)E dependentYes, spouses are generally work-authorized.
O-1 (extraordinary ability)O-3No.
TN (Canada/Mexico professionals)TDNo.
H-2A / H-2B (seasonal work)H-4 exists in theoryH-4 is legally possible but rarely practical for seasonal workers; dependents must show ties and funds, and the spouse cannot work.

Rules on dependent work authorization have changed several times in recent years, always verify the current position at uscis.gov before making family decisions.

What dependents can and cannot do

  • School: yes. Dependent children can attend U.S. public schools, and H-4/L-2/E dependents can generally study without a separate student visa.
  • Work: usually no, unless their category grants it (see table). Working without authorization is a serious violation that can damage the whole family's immigration future.
  • Travel: yes, dependents can generally travel in and out with valid documents while your status is valid.
  • Healthcare: plan for it. Dependents are not automatically covered by anything; ask whether your employer's health insurance covers family members, and at what cost, before you commit.

The seasonal worker reality

An honest word for H-2A and H-2B workers: the programs are built around the worker coming alone for a season and returning home. Bringing a family on H-4 for a few months is legally conceivable but expensive and rarely approved as a practical matter, because dependents must convince a consular officer of nonimmigrant intent and sufficient funds. Many seasonal workers instead build a rhythm of seasons abroad and time at home, and treat longer-term visas as the family route. Understanding the difference between visa types is essential here, our guide to U.S. work visas explained lays out which categories fit which goals.

How the application works

  • Dependents apply for their visas at a U.S. consulate, either together with you or later, with proof of the relationship: marriage certificate, birth certificates, properly translated and, where required, apostilled or legalized.
  • They pay the standard visa application fee to the U.S. government, the same kind of fee you pay, through official channels only.
  • They will need their own passports, including children.
  • Processing follows your petition: dependents cannot be approved before the principal worker.

Start document gathering early, obtaining and translating civil documents is often the slowest step. Our checklist of documents you need to work in the USA applies to families too.

Watch for family-visa scams

Scammers sell "guaranteed family visas" and "special quotas for spouses." There is no such thing. Dependent visas are decided case by case by consular officers, nobody can guarantee one, and the only fees are official government fees. Anyone charging you for a guaranteed outcome is lying, the same rule as with job offers: legitimate actors never charge workers for promises.

This article is general information, not legal advice. Visa categories, dependent work rules, and fees change; check uscis.gov and travel.state.gov for current rules, and consult a licensed immigration attorney for advice on your family's specific situation.
